Mediation
Mediation is the process in which a trained mediator assists parties in conflict to reach a negotiated settlement. The mediator uses a variety of techniques and skills to encourage the parties to reach an acceptable solution. Courts generally require mediation prior to trial. However, even though mediation usually occurs in the context of a pending law suit, the parties are not constrained to reaching a settlement based on the law or legal remedies. For this reason, often the outcome of mediation is a solution much better than what a court can offer.
